WHEREAS, the Supervising Code Enforcement Officer has received information that the building(s) located at 17 Yvette Drive, Cheektowaga, New York, (S.B.L. #125.09-16-26, Record Owner: CACI, Russell S.) has become dangerous and unsafe to the general public and unfit for the purposes for which it may lawfully be used; and
WHEREAS, said building(s) has been inspected and a written report of the condition has been completed by the Town of Cheektowaga Supervising Code Enforcement Officer setting forth findings and recommendations in regard to the repair or demolition and removal of the building(s), and said written report describes extensive deterioration and damage to the building and premises and recommends that the building(s) be demolished and removed as soon as possible; and
WHEREAS, the Town Board has fully considered such written report and has determined that the building(s) is dangerous and unsafe to the general public and unfit for the purposes for which it may lawfully be used; NOW THEREFORE BE IT
RESOLVED, that this Town Board accepts the findings and recommendations of the Supervising Code Enforcement Officer, dated September 1, 2015; and BE IT FURTHER
RESOLVED, that a notice shall be served, pursuant to Section 75-7 of the Cheektowaga Town Code, upon the owner, executor, administrator, agent, lessee or any person having a vested or contingent interest in such unsafe building as shown by the records of the Receiver of Taxes or of the County Clerk, which notice shall have the contents prescribed by Section 75-6 of said Town Code, including, but not limited to a date, time and place for a hearing before the Town Board in relation to such dangerous and unsafe building, which hearing shall be scheduled not less than five business days from the date of service of the notice; and BE IT FURTHER
RESOLVED, that a hearing before this Board in relation to said dangerous and unsafe building(s) shall be held on the 28th day of March, 2017, at 7:00 P.M. at the Cheektowaga Town Hall, 3301 Broadway, Cheektowaga, New York, and BE IT FURTHER
RESOLVED, that the Code Enforcement Office and/or the Town Attorney’s Office be and hereby are directed to serve notice of said hearing on all interested parties.
