NOTICE OF ADOPTION
APPROVAL OF REZONING - 93 MARYVALE DRIVE
WHEREAS, For the Love of Cooking, LLC petitioned for a rezoning from CM- General Commercial to MS-Motor Services District for property owned by them and located at 93 Maryvale Drive, Cheektowaga, New York, which property is described in the attached legal description, to permit the re-use of an existing motor vehicle repair building for minor motor vehicle repairs, AND
WHEREAS, a public hearing on such petition was held before this Town Board on the 20th day of May, 2013 at 6:45 P.M., after publication and service of the notices required by the provisions of the Code of the Town of Cheektowaga (“Zoning Law”), and the Town Law; and all interested parties were given an opportunity to be heard at such hearing, and
WHEREAS, the Cheektowaga Planning Board has reviewed such application and has recommended approval thereof, and
WHEREAS, this Town Board previously issued a Negative Declaration under SEQRA and the Town Environmental Impact Review Ordinance for this rezoning, NOW, THEREFORE, BE IT
RESOLVED, that the application For the Love of Cooking, LLC for the rezoning from CM- General Manufacturing to MS-Motor Services District of the property described in the attached legal description for the re-use of an existing motor vehicle repair building for minor motor vehicle repairs be and the same is hereby approved, and BE IT FURTHER
RESOLVED, that any future motor service uses which are not for minor motor vehicle repair, including collision work, as well as, the other uses permitted in the MS- Motor Service zoning district; a special use permit must resubmitted to the Town Board to determine whether the new motor service use is substantially in agreement with the intent of this rezoning approval, and BE IT FURTHER
RESOLVED, that the Zoning Map and Law of the Town Of Cheektowaga be amended in accordance with the above.
All that tract or parcel of land situate in Town of Cheektowaga, County of Erie, and State of New York, being part of Lot No. 35, Township 11, Range 7 of the Holland Land Company’s Survey, described as follows:
BEGINNING at a point in the southerly line of Maryvale Drive (formerly Pine Ridge Road) distant 160 feet west from the east line of Lot No. 35, said east line of Lot No. 35, being also the west line of Harlem Road as laid out as a 66 foot highway; thence southerly parallel with the east line of Lot No. 35 a distance of 175 feet to a point; thence westerly parallel with Maryvale Drive, a distance of 90 feet to a point; thence northerly parallel with the east line of Lot No. 35 a distance of 175 feet to a point in the southerly line of Maryvale Drive; thence easterly along the southerly line of Maryvale Drive 90 feet to the point or place of beginning.
